Allegation(s)

1)OLAF acted unlawfully when interviewing the complainant as a person concerned in an external investigation, given that there was no legal basis for doing so.

2) OLAF failed to conduct the interview properly, given that it (i) did not set out at the beginning of or during the interview the allegations against him; (ii) did not properly inform him of his rights; and (iii) attempted to intimidate him.

3) OLAF failed to investigate properly the conduct of ST, ST's auditors and Mr X and to inform the complainant of the result of any examination that it may have carried out in respect of Mr X.
