Decision on case 1073/2019/LM on the alleged failure by the European Commission to provide sufficient information to a former staff member about issues related to pension rights

Dear Ms X,

On 10 June 2019, you submitted a complaint to the European Ombudsman against the European Commission. The Ombudsman has asked me to deal with the case and reply to you on her behalf.

Your complaint concerns the way in which the Commission handled your request for a transfer of pension rights combined with a request for redemption of the period you worked in the Commission as an auxiliary agent. You argue that the Commission did not deal with your file fast enough, that it made several mistakes and that it provided information that is confusing and difficult to understand.

Based on the information you provided us, the Ombudsman finds no maladministration by the Commission.

We note that, despite some initial mistakes and uncertainties regarding some aspects of your file, the Commission has now given you all the necessary information for you to take a decision on the matter.

From the documents you have sent to the Ombudsman, it appears that the Commission informed you of the calculation of your pension rights already in September 2017 and that it informed you of the amount of pensionable years to be transferred in December 2017. The Commission has consistently maintained that you must accept or refuse the transfer as a whole, whilst trying, on your request, to find solutions that could be more favourable for you.

Furthermore, the Commission has been responsive to all your queries and has done its best to explain an issue that is inherently complex.

I realise that this decision will disappoint you, but I hope that the above information and explanations are nevertheless helpful.

On this basis, the Ombudsman closes the case.
