Dear Mr Y,

We informed you on 11 July 2022 about the above complaint, asking the Commission to reply to the complainant’s confirmatory application of 6 April 2022 by 5 September 2022.

Regrettably, the Commission has now informed us that it is not yet in a position to reply to the complainant, as it still has to consult more than 20 external parties. The Ombudsman is very concerned about the delay in dealing with the complainant’s request.

We have now decided that it would be useful to receive, at this stage, a list of the documents the Commission has identified as falling within the scope of the complainant’s request. We would also like to share this list with the complainant.

We would be grateful to receive the list by 21 September 2022. If any document on the list is classified, please indicate so and the level of classification.

As we have stated in our letter of 11 July 2022, we might need to ask to inspect the relevant documents, should the delay in handling the complainant’s confirmatory application persist.
