Stěžovatel vyjádřil obavy ohledně toho, že Evropská komise vyjímá tzv. „kontroly reality“ ze svých standardních opatření v oblasti transparentnosti. Kontroly reality jsou formou konzultací se zástupci společností prováděných v rámci práce Komise na zjednodušení právních předpisů EU.
