Decision of the European Ombudsman in the case 2288/2019/DL on the European Commission’s failure to provide a proof of domicile for a former staff member

Dear Mr X,

On 18 December 2019, you submitted a complaint to the European Ombudsman against the European Commission. Your complaint concerns the failure of the Commission to provide you with the requested document, namely a proof of domicile.

Based on the information you provided us, the Ombudsman finds no maladministration.[1]

The Commission informed you that a ‘legitimation card’ is only provided to agents and officials while they are still employed by the Commission. It informed you that it had cancelled your legitimation card when your employment at the Commission ended.

The Commission has provided you with explanations on how to obtain a residence permit or a permanent resident permit (it informed you that you needed to contact your municipal authorities).

Please note that it does not fall within the responsibility of the Commission to provide you with a proof of domicile. It also responded in a helpful manner by providing you with relevant documents and guidance on how to obtain a residence permit. I therefore consider that the response of the Commission was reasonable.
