Dear Mr K.,

On 5 December 2006, you submitted a complaint to the European Ombudsman concerning the European Commission's handling of alleged infringements of Community law by certain German courts.

On 11 January 2007, I forwarded the complaint to the President of the Commission.

By letter of 24 January 2007, you sent further information relating to your complaint. I forwarded this information to the Commission on 5 February 2007 and informed you accordingly on the same day.

The Commission sent the original English version of its opinion on 29 May 2007 and a translation of it into German on 20 June 2007. On 22 June 2007, I forwarded both documents to you with an invitation to make observations, which you sent on 23 July 2007.

In a letter of 9 October 2007, you informed me that the German Federal Administrative Court ("Bundesverwaltungsgericht"), in a judgment of 23 August 2007, corrected the jurisprudence of German courts against which you had complained to the Commission. You stated that, against this background, you wished to withdraw your complaint and thanked me for my helpful support.

I therefore close the case. The President of the Commission will also be informed of this decision.
