The case concerned the European Commission’s refusal to grant public access to parts of a legal evaluation on extending the period for negotiations concerning the United Kingdom’s withdrawal from the European Union. The Commission invoked an exception to the EU’s rules on public access to documents, arguing that disclosing the information would undermine the ongoing decision-making process.

The Ombudsman found that, at the time of the Commission’s decision, the decision-making process regarding the withdrawal of the United Kingdom was still ongoing. However, she proposed, as a solution, to grant access to parts of the evaluation concerning the European elections, which had since taken place. Regrettably, the Commission did not accept her solution proposal.
