Decision in case 2164/2018/EIS on the European Commission’s failure to reply to a letter concerning an alleged breach of Directive 2005/36/EC on the recognition of professional qualifications

1. On 24 November 2017, the complainant submitted to the European Commission a complaint for infringement against the Italian State concerning a breach of Directive 2005/36/EC on the recognition of professional qualifications. On 12 April 2018, the Commission sent him a pre-closure letter which the complainant contested on 17 April 2018. The Commission then replied to the complainant on 30 July 2018, informing him that it had closed the case in the absence of a reaction on his part. The complainant replied to this letter on 2 August 2018. Having received no reply, he addressed the European Ombudsman on 16 December 2018.

2. The Ombudsman’s staff in charge of the inquiry contacted the Commission. Subsequently, the Commission replied to the complainant on 11 January 2019 and apologised for the delay.

3. Since a reply has been sent, the issue underlying the complaint in question has been resolved[1] and we have therefore decided to close the case[2].
