Sťažovateľ vyjadril obavy v súvislosti s tým, že Európska komisia vyníma tzv. kontroly reality zo svojich štandardných opatrení v oblasti transparentnosti. Kontroly reality sú formou konzultácií so zástupcami spoločností, ktoré sa vykonávajú v súvislosti s prácou Komisie na zjednodušení právnych predpisov EÚ.
