The present case concerns the behaviour of a civil servant working for a Community body. To the extent that the behaviour of such a person can be attributed to his or her official function, it can be the subject of a complaint to the European Ombudsman which is directed against the Community institution or body this agent is working for. However, the Ombudsman is not able to deal with complaints concerning the behaviour of such an agent if the latter acts in a private capacity.
