Where an institution invokes the presumption that disclosure of the documents on its file would undermine the protection of the interest set out at Article 4 (2), third indent of Regulation 1049/2001, an applicant will hardly ever be in a position to try and argue that this presumption does not cover a given document on the institution's file if he does not know the exact contents of that file. If the applicant is not at least provided with information on which documents are effectively on that file, the effectiveness of Regulation1049/2001 risks being called into question.
