Decision in case 2008/2019/TM on the European Commission’s failure to answer correspondence concerning an issue of custody dispute

1. On 19 October 2018, the complainant wrote to the European Commission about the enforcement of a court order in custody matters. As the complainant did not receive a reply, she turned to the European Ombudsman, on 22 November 2018.

2. The Ombudsman’s inquiry team contacted the Commission, which then replied to the complainant on 21 February 2019. The Commission explained the EU rules on matters of parental responsibility and its powers in the area of custody. The reply is detailed, reasonable and in line with the applicable rules.  

3. As a reply has now been sent, this complaint is resolved[1] and I have decided to close the case[2].
