Maladministration can also exist where a Community institution or body fails to comply with a legal rule and that, in a society governed by the rule of law, any public administration must interpret the law and follow the law correctly. In this regard, the Ombudsman has constantly emphasised that the Court of Justice is the highest authority with respect to the interpretation of Community law.
