The Ombudsman has constantly adopted the position that a proper exercise of the Commission's discretion requires that the complainants be properly informed of the reasons for the relevant decisions and enjoy the procedural guarantees granted to them by the Commission's Communication COM/2002/0141 to the European Parliament and the European Ombudsman on relations with the complainant in respect of infringements of EU law ('the 2002 Communication') in conjunction with the European Code of Good Administrative Behaviour ('the Code') and the Commission's Code of Good Administrative Behaviour. The complainants should thus be properly informed of any development in the Commission's procedure and they should be so informed in good time.
