The Ombudsman underlines that it is good administrative practice for an institution fully to consider all possible issues of public interest in disclosure of a document. As such, while an insitution should carefully examine the arguments in relation to overriding public interests in disclosure, put forward by a person seeking public access under Regulation 1049/2001, the institution concerned should also take into consideration, ex officio, any other possible issues of public interest. In fact, the institution holding the document is in a better position to evaluate all possible issues relating to the public's interest in disclosure of the documents given that, contrary to the applicant, it clearly knows the specific content of the document in question. This is particularly important as regards documents relating to the legislative process.
