The Ombudsman notes that, according to his well-established decisional practice, while failure to respect legal obligations is a form of maladministration, the concept of maladministration is broader than the concept of legality. Thus, if Parliament had failed to comply with procedures to which it had publicly committed trough its website and/or through a brochure, this would constitute an instance of maladministration. Therefore, in the Ombudsman's view, what is relevant for the present purposes is the content of the information provided by Parliament, rather than the alleged non-binding nature of its website and its brochure.
