The European Council would have acted in accordance with principles of good administrative behaviour if, after having received the complainant's request for a copy of the relevant rules, it had explained to the complainant the two step procedure foreseen in Regulation 1049/2001. This would have been in conformity with the obligation to give advice laid down in Article 10(3) of the European Code of Good Administrative Behaviour.
