The Ombudsman takes the view that, in carrying out its duties relating to infringements and public access to documents, the Commission should take reasonable steps to enable citizens to understand that, if a Member State refuses access to letters of formal notice or reasoned opinions that have been sent to it by the Commission, the Member State is responsible for that refusal under national law.
