Regulation 1049/2001 establishes an administrative procedure by means of which applicants may ask an institution to reconsider its position, before they can turn to the Court of Justice or to the Ombudsman. The system established by Regulation 1049/2001 thus takes into account a situation in which an institution may not have handled a specific initial application properly, in substance or in procedure, and gives the institution a chance to correct its mistake(s) when deciding on the confirmatory application.
