Handling of a complaint alleging violation by Portugal of EU law on State aids

Allegation(s)

The Commission failed properly to handle the complainant's complaint dated 9 May 2011, in which it alleged that Portugal failed to apply Article 12(2)(c) of the General block exemption Regulation correctly ('the complaint').

Claim(s)

The Commission should:

1) thoroughly analyse and investigate the complaint, keeping the complainant informed of the developments at all stages and making any resulting conclusions public, with a view to guaranteeing a uniform application of EU law; and

2) provide the correct interpretation of Article 12(2)(c) of the General block exemption Regulation, having particular regard to the Portuguese linguistic version of that article.
