Length of time for which salary should be paid during sick leave to a person working for the EU military force in Bosnia Herzegovina (EUFOR Althea)

Allegation(s)

1) EUFOR Althea wrongly failed to pay the complainant's salary for the months of September and October 2010.

2) By serving the notice of termination of employment on the complainant and allowing the notice period to run while he was on sick leave, EUFOR Althea failed to interpret Article 11 of the Civilian Staff Rules according to the general principles of EU social law.

Claim(s)

1) The complainant should be paid his salary for the months of September and October 2010.

2) EUFOR Althea should consider that the termination notice started to run at the end of the complainant's sick leave and it should pay the complainant the corresponding salary difference.
