Letter from the European Ombudsman to the European Commission on its failure to reply to a request for public access to draft agreements for the purchase of vaccines against COVID-19
Correspondence - Date Monday | 19 April 2021
Case 731/2021/MIG - Opened on Monday | 19 April 2021 - Decision on Monday | 17 May 2021 - Institution concerned European Commission ( Settled by the institution ) - Country Germany
Dear Mr Y,
The Ombudsman has received a complaint from X against the European Commission. The Ombudsman has asked me to deal with the case on her behalf.
The complaint concerns the Commission‘s failure to reply to the complainant’s request for public access to “all drafts of all Advance Purchase Agreements with the companies AstraZeneca, Sanofi-GSK and Johnson & Johnson” dated 13 October 2020 and registered under GESTDEM 2020/6122. The Commission said on 30 November 2020 that its reply was being finalised and that it would be sent to the complainant after it had been signed. However, it seems that this has not been done.
I would suggest, if you have not done so in the meantime, that you now reply to the complainant and inform us when it is done. We would be grateful if you could send your reply by 10 May 2021.
Attached to this e‐mail, please find a copy of the complaint.
Yours sincerely,
Rosita Hickey
