The Ombudsman has consistently taken the view that maladministration is a broad concept and that good administration requires compliance with legal rules and principles. However, principles of good administration go further, requiring EU institutions and bodies not only to respect their legal obligations, but also to act in a reasonable and proportionate manner. Findings of maladministration by the Ombudsman do not, therefore, automatically imply illegal behaviour which could be sanctioned by a court.
