Unfair refusal to recognise the existence of a serious illness

Allegation(s)

1) The Commission failed to provide sufficiently specific grounds for its decision to reject the complainant's application for recognition of the existence of a serious illness according to Article 72(1) of the Staff Regulations.

2) The Commission made a substantive error by concluding that a severe cataract would not result in a "shortened life expectancy".

3) The Commission failed to provide information on the appeal possibilities available for challenging its decision on the existence of a serious illness.

Claim(s)

The Commission should accept the complainant's application for recognition of the existence of a serious illness.
