Decision in case 960/2016/TM on the European Investment Bank´s alleged failure to handle a complaint in a timely manner

The case concerned the alleged failure of the European Investment Bank (EIB) Complaints Mechanism to handle a complaint in a timely manner. The Ombudsman inquired into the issue and found that the delay was justified due to the complexity of the subject matter of the complaint. The Ombudsman therefore found no maladministration by the EIB.

Decision in case 1102/2016/JN on the Commission’s failure to reply to correspondence and to fully disclose a document

The case concerned the Commission’s failure to reply to the complainant’s correspondence in the context of a financial audit at the Member State level. Following the Ombudsman’s intervention, the Commission replied. It disclosed the document requested by the complainant but redacted some personal data (names of physical persons). The Ombudsman found that the Commission correctly justified the redaction under Regulation 45/2001.

Decision of the European Ombudsman in case 1229/2014/ZA on OLAF's handling of allegations concerning mismanagement of EU funds in Greece

The complainant informed OLAF of alleged mismanagement of EU funds in Greece. OLAF failed to acknowledge the complainant's correspondence and failed also to inform the complainant of whatever action it had taken and of the outcome. Following the Ombudsman's intervention, OLAF acknowledged the procedural shortcomings in its handling of the case and apologised. It also took steps to avoid similar situations in the future. Finally, OLAF informed the complainant of the steps it had taken as regards the substance of its case. The Ombudsman concluded that OLAF had settled the complaint. However the Ombudsman made a further remark with a view to improving OLAF procedures as regards its monitoring of closed cases transmitted to competent national authorities.

Din l-inkjesta fuq inizjattiva proprja tikkonċerna kif il-Kummissjoni Ewropea tiżgura li jkun hemm konformità mad-drittijiet fundamentali miġbura fil-Karta tad-Drittijiet Fundamentali tal-Unjoni Ewropea meta tiġi implimentata l-politika ta' koeżjoni tal-UE mill-Istati Membri. Din tnediet hekk kif l-Unjoni bdiet perjodu ta' finanzjament ġdid ta' seba' snin, li jkopri l-2014-2020, taħt qafas legali ġdid.

Il-politika ta' koeżjoni tal-UE tfittex li jitnaqqsu d-disparitajiet bejn il-livelli ta' żvilupp tad-diversi reġjuni tal-UE. Meta titqies il-viżibbiltà tal-Unjoni fil-proġetti li huma ffinanzjati permezz tal-politika ta' koeżjoni - mit-titjib fis-servizzi ta' emerġenza fir-Rumanija sat-tneħħija tal-mini fil-Kroazja - l-Ombudsman temmen li l-Kummissjoni għandha tagħmel dak kollu fis-setgħa tagħha biex jiġi żgurat ir-rispett għad-drittijiet fundamentali bil-mod kif jintefqu l-flus. Il-fatt li l-Kummissjoni mhijiex responsabbli direttament mill-ġestjoni tal-fondi m'għandu qatt jintuża bħala raġuni li ma taġixxix jekk id-drittijiet fundamentali jinkisru, jew hemm ir-riskju li jinkisru.

L-inkjesta fuq inizjattiva proprja involviet lill-Kummissjoni, lill-ombudsmen nazzjonali u lir-rappreżentanti tas-soċjetà ċivili. Abbażi tal-feedback tagħhom, l-Ombudsman ipproduċiet tmien linji gwida għal titjib bħala appoġġ lill-Kummissjoni hekk kif din tissorvelja lill-Istati Membri f'dan il-qasam.

Decision of the European Ombudsman closing the inquiry into complaint 1205/2013/JF against the European Commission

The case concerned a Swedish company that participated in a project financed by the European Commission's FP7 programme. Whilst the project was being implemented, the Commission decided to audit the company. The company disagreed with the audit results and, after the Commission had confirmed them, lodged a complaint with the European Ombudsman alleging a lack of objectivity on the part of the Commission and a failure to comply with the applicable rules.

The Ombudsman inquired into the issue and found no maladministration by the Commission. In particular, the audit results relating to the company's labour costs were based on the information that was available to the Commission at the relevant time. She suggested to the complainant that if it has further evidence, it consider submitting it to the Commission for its consideration. As regards the calculation of the company's productive time, the information which the complainant provided did not appear to be sufficient to permit the Commission to calculate the actual individual productive time, in accordance with the requirements of the FP7 rules. Consequently, the Ombudsman closed the case.

Deċiżjoni fil-każ 443/2011/ER - Rifjut inġust li tiġi aċċettata talba għall-pagament finali wara t-terminazzjoni tal-kuntratt

L-ilmentatur huwa kumpanija Taljana. Fl-2008, il-kumpanija daħlet fi Ftehim ta’ Għotja mal-EACI fi ħdan il-qafas tal-programm Marco Polo II tal-UE, li jappoġġja azzjonijiet immirati lejn it-trasferiment tal-merkanzija mit-trasport bit-triq għal mezzi ta’ trasport oħrajn, aktar ekoloġiċi.

L-azzjoni proposta mill-ilmentatur kienet tikkonċerna l-esportazzjonijiet mill-industrija taċ-ċeramika Taljana lejn Spanja u kienet ingħatat għotja sa EUR 4 miljun. Madankollu, minħabba l-kriżi ekonomika globali u l-waqgħa f’daqqa tas-suq Spanjol tad-djar, id-domanda għat-trasport taċ-ċeramika mill-Italja lejn Spanja naqset b’mod drammatiku wara li l-Ftehim ta’ Għotja kien iffirmat. Konsegwentement, l-EACI aċċettat it-talba tal-ilmentatur biex tissospendi l-implimentazzjoni tal-azzjoni.  F’Ġunju tal-2010, peress li l-ilmentatur ma kienx f’pożizzjoni li jerġa’ jibda l-proġett, l-EACI tterminat il-Ftehim ta’ Għotja u infurmat lill-ilmentatur li kellu 60 ġurnata biex jissottometti rapport finali u biex jitlob il-ħlas finali.  Kien biss f’Jannar tal-2011 li l-ilmentatur issottometta talba għal pagament finali ta’ EUR 2 miljun. Fil-fehma tal-EACI, dan kien tard wisq.

Fl-ilment tiegħu lill-Ombudsman Ewropew, l-ilmentatur allega li l-EACI kienet aġixxiet b’mod inġust. L-ilmentatur argumenta li d-dewmien biex jissottometti t-talba għall-pagament finali kien ġustifikat mit-tentattivi tiegħu, magħmula b’intenzjoni tajba, biex jerġa’ jibda l-azzjoni u li, fl-assenza tar-rapport finali, l-EACI kellha tal-inqas tibbaża d-deċiżjonijiet tagħha fuq iċ-ċifri li jirriżultaw mir-rapport interim sottomess lilha f’Ottubru tal-2009. Fl-opinjoni tagħha, l-EACI kienet tal-fehma li hija kienet kompletament konformi mad-dispożizzjonijiet tal-Ftehim ta’ Għotja.

L-Ombudsman fakkret li l-kunċett ta’ amministrazzjoni tajba huwa usa’ minn dak tal-legalità. L-Ombudsman enfasizzat li għalkemm l-EACI ma kinitx legalment obbligata tagħmel dan, il-Ftehim ta’ Għotja ma kienx iwaqqafha milli taċċetta talbiet tard għall-pagament finali. Fid-dawl ta’ (i) impatt qawwi partikolari li l-kriżi ekonomika kellha fuq il-proġett tal-ilmentatur, u (ii) l-fatt li l-EACI kienet diġà approvat ir-rapport interim sottomess f’Ottubru 2009, l-Ombudsman dehrilha li d-deċiżjoni tal-Aġenzija li tirrifjuta t-talba tal-ilmentatur għall-pagament finali ma kinitx ġusta għal kollox. Għaldaqstant, l-Ombudsman għamlet proposta għal soluzzjoni amikevoli, fejn stiednet lill-EACI biex tivvaluta t-talba tal-ilmentatur għall-pagament finali ta’ EUR 2 miljun abbażi tar-rapport interim tal-ilmentatur ta’ Ottubru 2009. L-EACI aċċettat il-proposta u l-Ombudsman għalqet il-każ.
