It would have been reasonable for the Commission to have investigated this alleged conflict of interests as soon as it became aware of it. Such an immediate investigation would have ruled out, with a reasonable degree of certainty, any possibility that the tender procedure had been unduly influenced, and thereby have prevented unjustified suspicion arising with regard to the actions of the evaluation committee.
