Decision of the European Ombudsman closing complaint 349/2013/EIS against the European Commission

Dear Mr President,

Please find enclosed a copy of my decision letter to the complainant in the above case, in which the complainant alleged that the Commission failed to inform him about its referral of case 2007/4652 to the Court of Justice.

In the decision letter, I inform the complainant that I contacted the relevant service of the Commission in this regard, and that the Commission replied on 22 March 2013.

After a thorough examination of the reply provided by the Commission, and the complainant's observations on that reply, I concluded that the Commission has taken steps to settle the matter and have closed the case.

I have also decided to issue the following further remark:

If similar situations arise in the future, it would be in line with a culture of service for the Commission to apologise for the delay in responding to the citizens concerned.

I would be grateful if the Commission could inform me by 31 January 2014 of any action it has taken in relation to my findings. I will take account of these responses when carrying out my annual assessment on how institutions and bodies have reacted to my conclusions.
