Decision of the European Ombudsman on complaint 3059/2006/JMA against the European Commission

THIS COMPLAINT WAS TREATED AS CONFIDENTIAL. THE DECISION HAS THEREFORE BEEN ANONYMISED. THE MASCULINE FORM HAS BEEN USED THROUGHOUT.

Strasbourg, 31 January 2007

Dear Mr X,

On 28 September 2006, you lodged a complaint with the European Ombudsman against the European Commission on behalf of the firm Y, concerning the contract between the Commission and Y for the implementation of a number of training activities in a third country in 2004-2005. You alleged in your complaint that the Commission had failed to meet its contractual obligations in that it failed to pay Y final invoice. You therefore claimed that the Commission should honour its contractual obligations and pay Y the outstanding amount plus interest.

On 8 November 2006, I forwarded your complaint to the President of the Commission with an invitation to submit an opinion.

By emails dated 14 November 2006, you informed me that the financial situation you had complained about appeared to have been resolved. In this regard, you expressed your satisfaction with the Ombudsman's efficient intervention in the case.

The Ombudsman therefore considers that the Commission has taken steps to settle the matter and has thereby satisfied you. The Ombudsman therefore closes the case.

The President of the Commission will be informed of this decision.

Yours sincerely,

P. Nikiforos DIAMANDOUROS
