The case concerned a refusal by the Court of Justice of the European Union to grant public access to an administrative document held by the Court. The Court first refused to confirm whether the specific document in question existed. It also argued that documents of the type requested by the complainant contained personal data and could not be disclosed without infringing personal data rights of the persons concerned.

The Ombudsman found that the Court’s arguments were reasonable and its refusal justified.

The Ombudsman therefore closed the inquiry with a finding of no maladministration.
