The European Commission's refusal to give public access to documents concerning the French national plan under the Recovery and Resilience Facility

The complainant asked the European Commission to grant public access to documents related to the French national plan under the Recovery and Resilience Facility (RRF). After having consulted with the French authorities, the Commission refused to grant access to the documents. In doing so, it invoked exceptions under the EU legislation on public access to documents, arguing that disclosing the documents - even those documents that originate from the Commission - could under the financial, monetary or economic policy of France.

The Ombudsman opened an inquiry and sought to inspect the documents in question.
