in case 871/2016/DK on the Commission’s failure to reply to correspondence
1. The complainant had written to the European Commission concerning the alleged violation of his fundamental rights guaranteed under the Luxembourg Penal Code and the Victims’ Rights Directive by Luxembourgish authorities.
2. On 10 June 2016, he complained to the European Ombudsman that he has not received a reply to his letter.
3. The Office of the Ombudsman took contact with the relevant service of the Commission. The service then replied to the correspondence on 20 July 2016. In its reply, the Commission stated that it had never received the complainant’s letter and that is why the complainant had not received a reply.
4. On 31 July 2016, the complainant acknowledged receipt of the Commission’s reply.
5. As the matter thus is solved, the Ombudsman closes the case.
The complainant and the Commission will be informed of this decision.
