Decision of the European Ombudsman closing his inquiry into complaint 1261/2009/TS against the European Commission

Dear Sir,

By letter of 27 November 2009, you submitted your observations to the European Commission's opinion on your above-mentioned complaint. In this letter you inform me that you disagree with my decision to open an inquiry into your complaint 1261/2009/TS. You also inform me that the letters of 7 October 2009 and 4 November 2009, by which you submitted supporting documentation and additional arguments in relation to your complaint 1261/2009/TS, should be considered as a new complaint.

In these circumstances, I consider that you have withdrawn your complaint 1261/2009/TS. As regards your request to treat your letters of 7 October 2009 and 4 November 2009 as a new complaint, I consider that there are insufficient grounds to open an inquiry into a complaint based on these letters, because they merely contain supporting documentation and additional arguments in relation to complaint 1261/2009/TS.

Please find enclosed a copy of your initial complaint.
