Summary of the decision in case 1316/2016/TN on alleged shortcomings in the European Investment Bank’s Transparency Policy

This case concerned a complaint on alleged shortcomings in the European Investment Bank’s (EIB) Transparency Policy. The complainant first brought this issue to the attention of the EIB’s internal Complaints Mechanism (EIB‐CM, which) declared the complaint inadmissible. The complainants then turned to the Ombudsman to challenge the EIB-CM decision and to reiterate their concerns that the EIB’s Transparency Policy did not comply with EU and international rules on access to information.

The Ombudsman inquired into how the EIB-CM had dealt with the complaint. She noted that the EIB had launched a review of the EIB-CM Policy and Procedures, which will clarify how the EIB should address public concerns falling outside the mandate of the EIB-CM.

The Ombudsman also assessed whether the EIB Transparency Policy complies with the applicable EU legal framework.

The Ombudsman found that although there is room for improvement of certain provisions in the EIB Transparency Policy, the Policy is not worded in such a way as to amount to maladministration. The Ombudsman made a number of suggestions for improvement aimed at encouraging the EIB to improve the formulation of certain articles in its Transparency Policy.
