Allegation(s)

1) The Commission wrongly applied the General and Implementing Provisions ('GIP') published on 28 March 2011[1] to the complainant's request for a transfer of his pension rights which was made prior to the entry into force of those rules.

2) By dealing with certain requests for the transfer of pension rights submitted  after 1 January 2009 on the basis of the GIP published on 28 March 2011 when other such requests were handled on the basis of the 2004 GIP, the Commission failed to respect the principle of equal treatment.

3) The Commission provided the complainant with misleading information.

Claim(s)

The Commission should recalculate the complainant's annuities on the basis of the 2004 GIP. In the alternative, it should provide financial compensation to the complainant for the amount of annuities foregone.
