Allegation(s)

1) The EU Delegation to Turkey endorsed the wrong attribution of the Tender to a Company whose tendered equipment may have caused reasonable doubts as regards their origin.

2) The EU Delegation to Turkey has failed to (i) clarify what measures it has taken, before awarding the tender, to contrast the complainant's substantiated suspicions concerning the actual origin of the equipment supplied by the successful company and (ii) reply to the complainant's concerns regarding the probating value of the certificates of origin.

Claim(s)

The EU Delegation to Turkey should verify whether the equipment proposed by the successful tenderer fulfils the rules of origin applicable to the Tender. In doing so, it should not content itself with a certificate of origin, which is not a reliable proof of the actual place of origin of a given product.
